Sharing private conversations on social media without consent may result in cyber libel charges, according to lawyer Jomax Ortiz.
In an interview with Bombo Radyo Bacolod, Ortiz explained that hacking accounts is not considered a crime, but posting the hacked content online is actionable under cyber libel laws.
Ortiz noted that controversies involving celebrities, like Maris Racal and Anthony Jennings, are not isolated incidents, as many similar cases occur daily.
He warned against recording sensitive interactions, such as sexual activities, as these can be hacked and leaked online.
The lawyer emphasized that disagreements over access to personal accounts are common sources of conflict among couples.
Ortiz cited a recent Supreme Court ruling allowing screenshots or records obtained through account hacking to be used as evidence in court.
However, the use of hacked information as evidence is applicable only to criminal cases, Ortiz clarified.
Despite the controversy involving Anthony Jennings and his ex-girlfriend Jam Villanueva, Ortiz stressed that sharing sensitive private conversations online without consent constitutes a serious offense.
The lawyer explained that while Villanueva may be emotionally hurt by the betrayal, she had no right to publicize erotic and sensitive private messages online.
Ortiz warned that Maris Racal could file a cyber libel case against Vilanueva for the unauthorized posts.
He urged the public to understand the serious consequences of sharing private content online and advised against allowing partners to record intimate activities.
